Section 1: Service Description
1.1 This service is provided by OMI OPTICS USA LLC (hereinafter referred to as "the Service Provider"), allowing users to remotely access and control telescopes for astronomical observations via the Internet.
1.2 Users may use the remote observation service during the hours of 9 PM to 6 AM local time of the observatory's location, during the rental period. The service may be unavailable due to weather or other force majeure events.
1.3 The Service Provider regularly offers free calibration data for use in astrophotography to help users optimize their observation results.
Section 2: User Responsibilities
2.1 Users shall ensure compliance with relevant laws and regulations while using the remote telescope service and shall not use the telescope for illegal activities.
2.2 Users shall use the remote telescope correctly according to the operation guide and will be responsible for any damage caused by improper operation.
Section 3: Copyright and Ownership
3.1 The ownership of the telescope equipment and related software belongs to the Service Provider.
3.2 The intellectual property rights of the astronomical data collected through the telescope belong to the user unless otherwise agreed upon.
Section 4: Disclaimer
4.1 The Service Provider does not assume responsibility for the imaging quality of the telescope during the rental period. Users should understand the imaging quality through pictures on the website or request sample images or a trial from the Service Provider before renting. The Service Provider is not liable for interruptions to the service or loss of observation data due to non-human factors such as equipment failure or network issues.
4.2 Users understand that astronomical observations are affected by weather, natural disasters, and other force majeure events, as well as potential improper software settings, and the Service Provider does not guarantee a success rate for observations.
Section 5: Privacy Policy
5.1 In order to complete user payments and communicate with users for any software or hardware issues that may arise during the service, the Service Provider may collect users' first names, last names, email addresses, phone numbers, and credit card information. Credit card information is stored on third-party platform Wix servers and is invisible to the Service Provider. The Service Provider shall protect the personal information provided by users during registration and use of the service and shall not disclose it to third parties without the user's consent.
5.2 During the payment process, some digital goods or services may collect users' address information due to the default settings of the payment widget provided by the third-party platform Wix used by the Service Provider, which are unchangeable. The Service Provider does not require this address information but will protect the personal information provided by users during registration and use of the service, and shall not disclose it to third parties without the user's consent.
5.3 User observation activities may only be recorded when the user requests technical support.
Section 6: Service Changes and Termination
6.1 The Service Provider reserves the right to modify or suspend the service contents upon prior notice.
6.2 If a user violates these Terms of Use, the Service Provider has the right to immediately terminate the service for that user.
Section 7: Governing Law and Dispute Resolution
7.1 The establishment, effectiveness, interpretation, and enforcement of these Terms of Use shall be governed by the laws of the United States of America.
7.2 Any dispute arising from the use of this service shall first be resolved through friendly negotiations between the parties. If negotiations fail, either party may submit the dispute to the courts of the Service Provider's registered location in the United States for litigation.
These Terms of Use shall take effect from the date the user accepts the terms, and the Service Provider reserves the right to final interpretation within the scope permitted by law.
